Important: These Terms of Service constitute a legally binding agreement between you and Community Car Care. By using our services, you agree to be bound by these terms.

1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the automotive detailing and ceramic coating services ("Services") provided by Community Car Care ("Company," "we," "us," or "our"), a sole proprietorship operating in British Columbia, Canada.

By engaging our Services, you ("Customer," "you," or "your") agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our Services.

2. Services Provided

2.1 Service Description

Community Car Care provides professional automotive detailing services, including but not limited to:

  • Ceramic coating application
  • Paint correction and polishing
  • Interior detailing and protection
  • Exterior washing and decontamination
  • Other automotive appearance services as agreed upon

2.2 Service Standards

We commit to providing Services with reasonable care and skill, consistent with industry standards. However, results may vary based on:

  • Pre-existing vehicle condition
  • Age and type of vehicle surfaces
  • Environmental factors
  • Customer maintenance and care

3. Booking and Scheduling

3.1 Appointments

  • All Services require advance booking
  • Appointments are subject to availability
  • We reserve the right to refuse service at our discretion

3.2 Cancellation Policy

  • Customer Cancellations: We understand if things come up. Just let us know.
  • No-Shows: Failure to appear for a scheduled appointment forfeits the appointment
  • Company Cancellations: We reserve the right to cancel or reschedule, you will be informed.

4. Pricing and Payment

4.1 Pricing

  • Prices are quoted based on vehicle size, condition, and services requested
  • Quotes are estimates and final pricing may vary based on actual vehicle condition, this will be communicated
  • Additional charges may apply for excessive contamination or unexpected issues
  • All prices are in Canadian dollars and subject to applicable taxes

4.2 Payment Terms

  • Deposits: 50% deposit required for ceramic coating services
  • Payment Due: Balance due upon completion of service
  • Accepted Methods: Cash, e-transfer, credit card (processing fees may apply)
  • Late Payment: Overdue accounts subject to 2% monthly interest

5. Customer Responsibilities

5.1 Vehicle Preparation

Customer must:

  • Remove all personal belongings from vehicle
  • Disclose any known issues or damage
  • Provide accurate vehicle information
  • Ensure vehicle has sufficient fuel for operation

5.2 Vehicle Condition Disclosure

Customer warrants that:

  • They have authority to authorize work on the vehicle
  • All disclosed information is accurate and complete
  • Vehicle is not subject to any liens or legal disputes affecting service

5.3 Aftercare Compliance

For warranty validity and optimal results, Customer must follow all provided aftercare instructions.

6. Liability and Disclaimers

6.1 Limited Liability

To the maximum extent permitted by law:

  • Our liability is limited to the value of services provided
  • We are not liable for pre-existing damage or defects
  • We are not liable for damage resulting from customer negligence or third-party actions
  • We are not liable for items left in vehicles

6.2 No Liability For

  • Indirect, incidental, special, or consequential damages
  • Loss of use, revenue, or profits
  • Damage from acts of nature or force majeure
  • Results not meeting unrealistic expectations

6.3 Insurance

We maintain business liability insurance. However, customers are advised to maintain their own comprehensive vehicle insurance.

7. Warranties and Guarantees

Specific warranty terms for ceramic coating services are provided in a separate Warranty Document. General service guarantees include:

  • 7-day satisfaction guarantee on workmanship (not product performance)
  • Commitment to address legitimate concerns promptly
  • No warranty on services where aftercare instructions are not followed

Statutory Rights: These Terms do not exclude or limit any statutory rights under the Business Practices and Consumer Protection Act of British Columbia.

8. Intellectual Property

8.1 Company Property

All content, trademarks, logos, and intellectual property related to Community Car Care remain our exclusive property.

8.2 Customer Content

By allowing us to photograph your vehicle, you grant us a non-exclusive, royalty-free license to use such images for:

  • Portfolio and promotional purposes
  • Social media and marketing materials
  • Website and advertising content

We will not disclose personally identifiable information without consent.

9. Dispute Resolution

9.1 Initial Resolution

We encourage resolution of disputes through direct communication. Please contact us promptly with any concerns.

9.2 Mediation

If direct resolution fails, parties agree to attempt mediation before pursuing legal action. Mediation costs to be shared equally.

9.3 Governing Law

These Terms are governed by the laws of British Columbia, Canada. Any legal proceedings shall be brought exclusively in British Columbia courts.

9.4 Limitation Period

Any claims must be brought within one (1) year of the date of service.

10. Indemnification

Customer agrees to indemnify and hold harmless Community Car Care, its owner, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Customer's breach of these Terms
  • Customer's negligence or willful misconduct
  • False or inaccurate information provided by Customer
  • Third-party claims related to Customer's vehicle

11. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Services, you consent to:

  • Collection of necessary personal and vehicle information
  • Use of information for service delivery and communication
  • Storage of information for legal and business purposes

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes become effective upon:

  • Posting updated Terms on our website
  • Notification to customers (for material changes)
  • Continued use of Services after changes constitutes acceptance

13. General Provisions

13.1 Entire Agreement

These Terms, together with any service agreements and our Privacy Policy, constitute the entire agreement between parties.

13.2 Severability

If any provision is deemed invalid or unenforceable, remaining provisions continue in full force.

13.3 Waiver

No waiver of any term is effective unless in writing and signed by Community Car Care.

13.4 Assignment

Customer may not assign rights or obligations without our written consent.

13.5 Force Majeure

Neither party liable for delays or failures due to circumstances beyond reasonable control.
